Homicide is a blanket term meaning the killing of one human being by another. While this may sound like murder, it is not identical in definition. Murder, in fact, is a subtype of homicide. Whereas murder means acts of killing, either premeditated and spontaneous, homicide in its wider scope takes into accounts instances of killing that are justified (such as self-defense) or accidental. In this way, homicide functions as a broader term, and therefore, is comprised of many different charges.
When affixed to homicide, the word “accidental” plays a large part in distinguishing out-and-out murder from a similar yet lesser charge: manslaughter. Manslaughter itself is broken down into two components: voluntary and involuntary manslaughter. Involuntary manslaughter occurs without what’s called “malice aforethought.” This means that the accused did not premeditate the death of the victim. Though the defendant may stand accused of the death of another human being, they may claim the death was completely accidental. Someone who drinks and drives and strikes a pedestrian may be guilty of involuntary manslaughter. Voluntary manslaughter, which is the term used for homicides wherein the accused party did have “malice aforethought,” is an allegation more akin to murder. What separates this charge from murder, generally, is a mitigating circumstance. If the defendant was provoked, and this provocation can be proven, a murder charge may be dropped to manslaughter.
If ones negligent actions resulted in the death of an unborn child of a pregnancy over 24 weeks, that too may constitute a homicide.
